Court Stays Acquisition Of 610 Acres For AP Capital

In a setback to AP government and its CRDA, the Hyderabad High Court has stayed implementation of the GO 548 issued on Nov 15 this year for alienation of about 618 acres of land to the Capital Region Development Authority in Kuragallu village of Mangalagiri mandal, Guntur district.

The court found fault with the recommendation of the district collector to the state government for transferring the above land to CRDA.

Justice M S Ramachandra Rao was passing this interim order in petitions filed separately by R Srinivasa Rao, B Srinivasa Rao and several others seeking to suspend operation of the impugned Government Order.

The petitioners’ counsels submitted that the subject lands were purchased by the petitioners through registered sale deeds, but the government now claims that they were assigned lands and that the sales were invalid, and hence they were taken by the government and transfer them to CRDA.

In fact, these assignments were made in 1922 and the law permits sale of such assigned lands if they were prior to 1954.

After hearing the case, the judge said, prima facie, the proceedings of the district collector recommending transfer by way of alienation of the subject lands in favour of CRDA, including the lands which have been assigned prior to 1954, illegal.

While suspending the GO, the judge issued a notice to the government.
