Mumbai Court rejects Alok Nath's plea seeking injunction order against Vinta Nanda

Mumbai Court rejects Alok Nath's plea seeking injunction order against Vinta Nanda

In what could be more trouble for actor Alok Nath, accused of sexual assaulting actor-director Vinta Nanda, 19-years ago, a Sessions court has rejected his wife's plea seeking restraining orders to the woman from making statments about the alleged incident, on online platforms and in newspapers.

Advocate Dhruti Kapadia appearing for Vinta Nanda said, "The court has refused to grant any interim relief by way of which the plaintiff had sought an injunction from making any further statements. The suit will come up for final hearing in due course of time."

Opposing, relief Kapadia had argued that the injuction order if passed would amount to curtailing of the woman's right to Freedom of Expression. Moreover, the defamtion suit cannot lie, because the woman was narrating the facts of her life. The Nath's in their suit have sought Re 1 as damages, claiming that Nanda had defamed them.

Advocate Ashok Saraogi, representing Naths, had argued that being a screenwriter, Nanda has made up a story of being raped. He accused Nanda of making allegations for money and to gain publicity. He claimed that his client is a victim of a media trial.
